Accidental Shooting of Wisconsin Man by Himself - No Charges


Allen Kieler was at his residence at 81 STH 35 in Jamestown Township. Kieler was showing visiting family members an older model .22 caliber handgun when the gun discharged a round. The round went through Kieler's hand, hit him in the shoulder area nd then went into the ceiling. Kieler was transported to Finley Hospital in Dubuque by Hazel Green EMS. Kieler is in stable condition. No one else was injured in the incident and no charges are being filed. Alcohol and foul play have been ruled out.
Stupidity with guns should be taken much more seriously than it is. These incidents are happening every day, day in and day out.

The gun didn't just discharge. He hit the trigger while it was aiming at himself. Would you trust a guy like that around guns?

Man Whose Gun Was Held as Evidence Wants it Back


A man whose gun was held as evidence in a case that is now closed wants his gun back — but the Longview City Attorney says he'll have to go to court to get it.

"What he's forcing me to do is take my chances or pay an attorney more than the gun is worth to get it back," said Kirk Turya, 43, of Longview, who feels his constitutional right to due process is being violated.

"I'm a hardworking, law-abiding citizen," said Turya, a long-haul trucker and a former Kelso reserve police officer. "If I had a criminal history, I could understand, but my record is spot clean."

Longview police originally took the 9mm Glock in October after Turya's brother Eric accidentally dropped it and it discharged in an apartment located in the 1700 block of Hemlock Street.

The bullet went through a table and floor and into the apartment below, where it ricocheted off a wall and the floor. Either the spent bullet or a piece of debris struck the leg of a little girl in the lower apartment, frightening her. Police said they saw no injury.

"The horror of that story is not lost on me," Kirk Turya said.

Eric Turya, 47, of Longview denied guilt, but on March 21 he acknowledged he could be found guilty of unlawfully discharging a firearm within the city limits. If he pays $568 in fines and court costs and commits no other crimes by May 21, the charge will be dismissed from his record.

District Court Judge Ed Putka did not order the firearm forfeited.
This is absolutely wrong. Until they adopt my one-strike-you're-out law, they shouldn't be able to get away with this.

Accidental Shooting of One Florida Cop by Another - No Charges

A St. Cloud officer was shot in the hand by a fellow officer Thursday afternoon, Police said.

Officials said the incident happened while the officers were serving a search warrant at a home on Tarpon Street in Kissimmee.

Officer John Nettles said he felt threatened during a drug raid and fired his gun, but he struck Officer Scott Wetherhold's middle finger on his right hand.
Now that's some serious damage to one of the most necessary body parts. Don't those hillbilly cops up there in central Florida learn the 4 Rules of Gun Safety?

"Merchant of Death" May Get Life







A federal judge at a sentencing hearing for a former Soviet arms dealer dubbed the Merchant of Death said Thursday she would sentence him to 25 years in prison for his conviction on terrorism charges that grew from a U.S. sting operation

Thursday's hearing was for 45-year-old Viktor Bout, who faced a mandatory minimum of 25 years in prison and a maximum of life in prison. The judge didn't immediately hand down the official sentence.

A federal appeals court on Wednesday ordered the owners of a gun show business and Alameda County authorities who have banned weapons from public property to mediate their 13-year-long dispute over whether the county's policy deprives citizens of their 2nd Amendment rights.

Lawyers for Russell and Ann Sallie Nordyke argued two weeks ago before the full U.S. 9th Circuit Court of Appeals that the county's 1999 ordinance banning weapons even at gun shows traditionally held at the county fairgrounds stripped them of a fundamental right and exceeded the U.S. Supreme Court's definition of reasonable restrictions on guns in the interest of public safety.
The agreement was, after the so-called pro-gun victories in Heller and McDonald, that guns for individual use IN THE HOME were protected. That's what we all agreed on. The gun-rights folks called it a victory, the con-control people laughed.

Now, in lower courts they're trying to expand that definition, with some success all across the country.

There is a tone of desperation in all this, though. At the same time they're trying to pass these boundary-pushing laws through, they're all heeding La Pierre's warning about Obama's second term. Just look at gun sales.

It would be all fun and games it it weren't so serious. Every once in a while a report comes through of someone saving the day with a truly legitimate DGU, while EVERY day there are lists and lists of gun accidents and misuse of firearms, many of which result in the loss of life.

Although I don't believe in Wayne La Pierre's sincerity, I think he's similar to a carny hustler, greedy for his own enrichment, but for once I hope he's right. The panic among gun owners will be palpable in the air.

Torii Hunter has a Close Call



Los Angeles Angels right fielder Torii Hunter had a frightening encounter with police at his Newport Coast home Wednesday afternoon, when two Newport Beach officers entered the house and escorted him upstairs -- with guns drawn -- so he could show them identification.

The incident began when Hunter accidentally triggered his home's alarm upon entering. A dispatcher called his wife's cell phone, but she was in Texas and didn't answer the call.
Credit is given to the cops who made the call, as well as Hunter, for conducting themselves just right.

Phew, that's what I call a close call. Just a bit of back-talking, a little resistance, and this might have been a very different story.

Accidental Shooting of Flint MI Policeman by Fleeing Man - Multiple Charges

Authorities say a Flint man faces multiple firearms charges, accused of accidentally wounding a state trooper by dropping a loaded gun while fleeing police.

Thirty-four-year-old Bobby Wells Jr. was arraigned Thursday in Flint District Court on charges that include carrying a concealed weapon and reckless discharge of a firearm.

Wells told Judge M. Cathy Dowd that he understood the charges and started to explain what happened before she reminded him of his right to remain silent.

Dowd said she would appoint a lawyer for him and ordered him jailed on a $150,000 bond. His next court date is Tuesday.

Authorities say Trooper John Gooch was hit in the abdomen Wednesday while he and other officers tried to catch Wells.
I suppose that was more than an accident and the guy needs to be in jail, but I couldn't help noticing when a cop gets hurt, the charges fly.

Another interesting aspect is how the gun fired when dropped. That's exactly why I would strip someone of their gun rights for a dropped gun that doesn't discharge. It's the same act, punishable by the same loss of gun rights.

Theme Park Owner Appeals his Gun Conviction

An owner of a Western theme park where a cowboy actor was accidentally shot in the head nearly six years ago has filed an appeal in the case, effectively delaying the start of his trial for at least a year, a Sussex County prosecutor said.

The appeal challenges a ruling issued in October by Superior Court Judge N. Peter Conforti, sitting in Newton, who upheld a state law prohibiting the transfer of firearms by an adult who does not have a state firearms carrying permit to an unsupervised juvenile.

Scott Harris, 43, playing the part of frontier lawman Wyatt Earp, was shot on July 7, 2006, during a skit at the theme park by a 17-year-old cowboy actor who accidentally loaded his .22-caliber handgun with live bullets instead of blanks. Harris was left partially paralyzed.
What's your opinion? Should the owner of the show be held responsible? Does jail time seem fair.

My idea is that jail is excessive for accidents except for repeat offenders. Loss of gun rights is always the appropriate punishment, plus in some cases, payment for damages.

Everything But Guns is Banned at the Republican National Convention in Tampa FL

But have no fear. While they have banned everything from paintball guns to water guns and ice chests and umbrellas, they have made sure that no protester has to go completely unarmed. Anyone can carry a concealed firearm -- as long as they have a concealed-carry permit. And that is not a hard permit to get. In some states, all it requires is the payment of a small fee.

Alaska Gun Shop Responsibility Case Goes to the State Supreme Court


A Bush-era federal law that protects gun dealers from being liable for homicides committed with guns from their shops is under fire in an Alaska court case that has led the Justice Department and gun-control activists to intervene.

At issue is whether a Juneau gun dealer is liable for letting a disheveled homeless felon leave his store with a rifle he used to kill a total stranger. The family of the slaying victim, Anchorage contractor Simone Kim, has filed a wrongful death lawsuit that has made it to the Alaska Supreme Court.



Jason Coday, a drifter with a police record in Utah and Nevada, fatally shot Kim in a random act of violence two days after arriving in Juneau and acquiring a gun from shop owner, Ray Coxe. Coxe said Coday walked out with the gun while his back was turned.

Guilty as charged is what I say. Gun shops have a responsibility to ensure that something like this cannot happen.

Accidental Shooting of Michigan Man - Shooter Charged with Misdemeanor


The accidental shooting of Eric Thomas, 37, of Marquette over the weekend has resulted in charges being filed.

The Michigan State Police arrested a 29-year-old Negaunee on Wednesday. He is facing a charge of careless discharge of a firearm, causing injury or death.

The man is currently out on bond pending his arraignment on April 9. The charge he is facing is a misdemeanor, punishable by up to two years and or a fine of $2,000.
Does this mean if you smack your wife around you lose your guns, but if you "accidentally" shoot someone you don't?

Shouldn't the act of shooting someone, regardless of how it happens, merit more than a slap on the wrist and retention of gun rights? Aren't people who prove they are capable of such gross negligence more likely to repeat their mistake than, say,  your general gun owner.

Accidental Shooting of Florida Pawn Shop Employee - No Charges

Police in Florida said a pawn shop worker was accidentally shot in the buttocks by another employee who was putting a gun into a display case.

The Margate Police Department said a worker at David Bari's Pawn Shop on State Road 7 left his semiautomatic Glock .40 caliber handgun on a counter when he stepped out around 6:30 p.m. Tuesday and another employee mistook it for a store item and attempted to place it into a display case, The Miami Herald reported Wednesday.

Police said the incident is being investigated but the preliminary investigation indicates the shooting was accidental.
Remember, "accidental" is a code word for "negligent."

There are several reports like this in the news every day, and you know what that means? It means there are hundreds that happen each day, day in and day out, only the most dramatic of which make the news. With very few exceptions, these incidents of negligence are committed by people familiar with guns, usually gun owners with enough experience with firearms that they should know better, at least that's what you'd think.

The facts are, however, that far too many gun owners are reckless, clumsy, stupid or otherwise unfit to responsibly own and use guns. The gun-rights advocates continually try to overlook that fact and pretend that "gun owners are responsible."

What's your opinion? Would better screening and training requirements help to improve the skills of these less-safe characters? Would it perhaps identify and disqualify some of the worst cases? Of course it would.

Pro-gun guys call that "punishing the vast majority" because of the few bad apples. What do you think of that? I really don't think better screening and training requirements is a "punishment." At worst it would be a minor inconvenience. How self-centered can one be to resist something like this which would do so much good?

Marine Sergeant Gary Stein to be Discharged




on the marine we wrote about before.

A federal judge refused on Wednesday to block disciplinary action against a Marine who criticized President Barack Obama on Facebook and called him a "domestic enemy" in a posting to an internal military network.

Marine Sergeant Gary Stein, 26, a meteorologist stationed at Camp Pendleton near San Diego, filed suit on Tuesday, saying the Marine Corps was violating his right to free speech. A Southern California congressman has rallied to his defense.

The Marines have said they initiated discharge proceedings against Stein after he posted political statements about Obama on a Facebook page he runs called the "Armed Forces Tea Party."
What's your opinion? Don't members of the military agree to some limitations on their 1st Amendment rights? Aren't there certain things they cannot say due to the fact that they wear the uniform? Isn't disrespect to the Commander-in-Chief a crime?

Driftglass on the Left and the Right



Driftglass wrote a wonderful piece about the differences between the Left and Right over the last 40 years.

I could go on -- endlessly (as if I haven't already :-) -- but the point is this:  there is no bigger, more destructive and more commonly repeated lie in American politics today than "Both Sides Do It".  Nothing else even comes close (all of the Right's gigantic, treasonous lies about Iraq, for example, eventually had to give grudging way to the realities of the catastrophic losses and failures to which that enterprise was doomed.)



Of course, none of the Bush Administration's various war criminals and Useful Idiots were ever docked so much as a day's pay or an erg Beltway prestige once their lies caught up with them (in fact a disturbing number of America's leading Neoconservative traitors actually leveraged their treachery into lucrative career advancements).  And of course once the Bush Administration's staggering concatenation of fraud, failure and lies started to blow in their faces, the party bosses had a whole new suit of lies ready and waiting to replace the old, worn out ones.

Accidental Shooting of Man's Great-Nephew Whom he Mistook for a Coyote - The Kid's Dead, The Shooter Charged with a Misdemeanor


A Clay County man faces misdemeanor charges in the accidental shooting of his great-nephew.

Seventy-nine-year-old Alfred Dawson of Nebo told investigators that he thought he was shooting at a coyote when he shot 15-year-old Dillon Dawson.

The incident occurred March 10 on Alfred Dawson's property.

The Division of Natural Resources charged Alfred Dawson with negligent shooting fatality and shooting at a wild animal not plainly visible.

Investigators determined that Alfred Dawson was about 444 feet away from Dillon Dawson when he shot the teenager with a rifle.
Misdemeanor? Whaaat?!!!

Should a man like that, capable of doing what he did, continue to own guns? Is that possible? Even in West Virginia they can't be that crazy for guns.

Clumsy, Irresponsible Gun Owner, New Hampshire State Rep. Kyle Tasker, Drops Gun





A Republican member of the New Hampshire House of Representatives who once posted a comment on Facebook about shooting at police officers accidentally dropped one of his guns on the floor at the start of a committee meeting Tuesday morning.

State Rep. Kyle Tasker (R-Nottingham) explained to onlookers that he had donated blood that morning and the effects caused him to drop his gun at the start of a House Criminal Justice and Public Safety Committee meeting. The committee was meeting to amend an abortion bill pending in the Legislature. The gun did not fire.

State Rep. Steve Shurtleff (D-Concord), a member of the committee, said that he was sitting three seats away from Tasker in the committee room when he heard "a clang" and saw that the gun was on the floor. Shurtleff said Tasker routinely wears two guns in a shoulder holster to legislative meetings.
There's no excuse, let alone that bullshit story about having given blood. People who insist on carrying guns and have a license to do so, should be held accountable for their irresponsibility. When this level of stupidity is combined with the paranoia of carrying not one but two guns at all times, you've got a dangerous situation. People like this should not be trusted with guns.

Trib Live reports with a follow-up to the Pittsburgh Psychiatric Clinic shooting.

After he tangled with police and was committed to a mental health facility in Oregon in 2010, John F. Shick should not have been able to buy a gun in America under federal law.

But an Albuquerque, N.M., man told investigators he sold two 9 millimeter handguns with no background check to a man resembling Shick when Shick responded to a newspaper ad in April 2011, Pittsburgh police Cmdr. Thomas Stangrecki said on Friday.

Private sales without background checks are legal under New Mexico law. Shick tried to buy a handgun in Oregon in January 2011 and was denied after a background check.

Pittsburgh police believe Shick used the handguns to fatally shoot therapist Michael Schaab, 25, of Regent Square and wound five others at Western Psychiatric Institute and Clinic on March 8.
I find it hard to believe gun-rights folks still try to justify this one.

The short answer is “no.” Here’s my thinking. My impression is that the folks who comment here, and probably many who read and do not comment, are for the most part extremely responsible and safe people. Although there’s some disagreement on things like home carry, for example, everyone seems to agree on the need for training and adherence to the 4 Rules of Gun Safety. The problem starts when you guys begin to extrapolate from that and apply these characteristics to gun owners at large. This is just not the case . . .

Accidental Shooting of Woman who Looked like a Bird - Shooter Gets Probation

A gentleman in Grand Junction, Colorado was put on probation after shooting a woman in the head. Apparently, he thought the woman was a red bird but really she just had a red mohawk. The woman, who did survive, "may have been passed out from intoxication prior to being shot" and that a bag of suspected meth was found near her, according to UPI. The man, Derrill Rockwell, 49, was ordered to pay $10,000 in restitution and put on five years probation.
Is that a gun-friendly response to what the guy did, or what? Probation for shooting someone by mistake while on the disqualified list?

Accidental Shooting of Shreveport Weed Dealer - Shooter Arrested


Shreveport police say one sister was shot and another arrested after an accidental shooting.

Conchetta Rhymes was accidentally shot by her sister, Alicia Rhymes, Sunday afternoon, while playing with a handgun. Conchetta Rhymes was driven to the hospital with a bullet wound to the stomach.

Police say detectives, granted permission to search the room where the shooting occurred, found the gun, about 3 ½ pounds of marijuana and $3,000 in cash. Alicia Rhymes was booked with possession of marijuana with intent to distribute while in possession of a firearm.
What's your opinion? Dealing pot and having a gun "accident" is a no-no, while just having a gun "accident" usually merits no charges.

Accidental Shooting of Another San Antonio Man While Hunting - No Charges


A man was shot in the head early Monday in what was described to authorities as an accident while hunting possums near Interstate 37 by the San Antonio River.
What's going on in San Antonio? Or, is this just business as usual? Law-abiding gun owners are shootin' each other like it's going out of style.

Accidental Shooting Death of San Antonio Man - No Charges

Local Fox News reports on the second "gun accident" in San Antonio in the last few days. The other guy was luckier. In both cases they were playing around with the gun.

San Antonio Police are investigating a deadly shooting of an active military man. On Sunday night a 911 call went out for a shooting on the 3300 block of Timber View was made. When emergency crews arrived they found a 25-year-old man had been shot. Investigators say that the victim's friend was taken into for questioning. He allegedly told police they were "fooling around" when the shot-gun went off accidentally. The victim died at the scene. So far no charges have been filed.

Miami Funeral Home Shooting - 2 Dead 12 Wounded

US News reports

At least one gunman opened fire on a crowd or mourners gathered at a Miami-area funeral home, killing two people and injuring 12, authorities said.

The shooting happened Friday night at Funeraria Latina Emanuel in the North Miami area. More than 100 people were gathered outside the funeral home when a car drove by and at least one person inside the vehicle fired shots, reportedly with a high-powered weapon.
Gun-rights fanatics will tell us this has nothing to do with the easy access to guns. Bad guys will always find ways to get them, they keep telling us. Yet, about the UK, they say knife crime has increased because guns are harder to get.

The reason they lie about this, and lie so stupidly that they contradict themselves about the situation in England, is because they're scared to death that they'll be held accountable for the damage their policies and lack of restrictions are causing.

Another contributing factor, it seems to me, is the attitude of never having to back down when you have a gun. This has been in the news lately with all the discussions about stand-your-ground laws, but it's an attitude that runs much deeper than that. It is a macho, bully-boy state of mind that works exactly the same in the "lawful" gun owners supposedly protecting his property as it does in the teenage gang member taking revenge at a funeral for having been disrespected.

The solution is obvious: strict gun control which would prevent unfit people from getting guns legally and choke off the gun flow from truly law-abiding to the criminals.

A man who bought guns legally in Colorado - but was arrested and slapped with a seven-year prison sentence for not having a permit to carry them in New Jersey - had two of the three charges filed against him overturned by the state Supreme Court on Friday.

Brian Aitken was arrested on Jan. 2, 2009 after he angrily left his mother's house in Mount Laurel, N.J., and she called police, fearing that her son was suicidal after his ex-wife canceled his visitation session with their son, according to court documents.
What's your opinion? What's the world coming to when even in New Jersey we cannot punish gun offenders? If this keeps up the gun guys will have to let go of that persecution complex they carry around.

Dwyane Wade's Nephew Among Chicago's Latest Gun Victims



A nephew of Miami Heat star Dwyane Wade was one of 13 men shot — two fatally — during a violent six-hour stretch in Chicago, another indication that violence is on the rise in the nation's third-largest city.

Wade's nephew was one of six males shot at a store on Chicago's South Side about 6 p.m. Thursday by hooded men who police said fled the scene in an SUV. One man was dead at the scene and four others — ranging in age from 16 to 24 — were hospitalized in critical condition. The Cook County medical examiner's office identified the slain man as Shawndell Harris, 22.
The pro-gun response to this is usually one of two things. They jokingly say this proves gun control doesn't work since there are severe restrictions in Chicago, or that criminals will always get guns anyway so any attempt to prevent that is futile.

Have you ever heard such self-serving and irresponsible responses to a serious problem in your life. I haven't.

Accidental Shooting of Texas Man Playing Around with a Gun - No Charges




A 34-year-old male was transported to SAMMC early Saturday morning following what witnesses are calling an accidental shooting.

Around 5 a.m. authorities were called to a hotel in the 6500 block of I-35 North after reports of a self-inflicted gunshot wound to the head.

Police are interviewing people in hotel room, but several people said they were messing around with the gun when it accidentally fired.
